(Dry Ice Products – Website Orders)

1. Scope
These General Terms and Conditions (“Terms”) govern the sale of dry ice and related products (“Products”) through this website. By placing an order, the customer (“Buyer”) agrees to be bound by these Terms.

2. Product Information

• Dry ice is solid carbon dioxide (CO₂), classified as a dangerous good under applicable transportation laws.

• Buyer acknowledges that dry ice sublimates (turns into gas) and must be handled in accordance with all safety instructions provided.

• Images and descriptions on the website are for illustration only; actual product may vary slightly.

 

3. Orders and Acceptance

• All orders are subject to availability and confirmation of acceptance.

• Brothers Industrial Services reserves the right to refuse or cancel orders at its discretion.

• Once confirmed, orders are binding and cannot be cancelled without seller’s consent.

 

4. Prices and Payment

• Prices are listed in Canadian dollars (CAD) unless otherwise stated.

• Applicable taxes are added at checkout.

• Full payment is required at the time of order and or receipt of invoice through the payment methods offered on the website.

 

5. Shipping and Delivery

• Call 1-888-598-5611 to schedule delivery.  Delivery charges will be billed separately and confirmed by email following an online order.

• While we strive to meet all delivery timelines, Brothers Industrial Services is not liable for delays caused by circumstances beyond our control.

• Due to sublimation, slight weight loss during transit is normal and are not grounds for a refund.

 

6. Storage and Safety

• Buyer agrees to store and use dry ice safely:

  • Always in well-ventilated areas.

  • Never in sealed containers.

  • With appropriate gloves and eye protection.

  • Out of reach of children and pets.

• Brothers Industrial Services is not responsible for injury, property damage, or loss resulting from improper handling or storage of dry ice.

 

7. Returns and Refunds

• Due to the perishable and hazardous nature of dry ice, all sales are final.  

• In the event of a defective product or an error in your order, please contact us within 24 hours of delivery to resolve the issue.

 

8. Limitation of Liability

• Brothers Industrial Services liability is limited to the purchase price of the dry ice supplied.

• Brothers Industrial Services is not liable for any indirect or unexpected damages, such as injuries, damage to property, or lost profits.

 

9. Compliance with Laws

• Buyer is responsible for ensuring that purchase, transport, storage, and use of dry ice complies with all applicable laws, regulations, and workplace safety rules.

 

10. Force Majeure

• Brothers Industrial Services is not liable for delays or failure to perform due to events beyond its reasonable control (including strikes, natural disasters, supply interruptions, accidents, or regulatory changes).

 

11. Governing Law

• These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws applicable therein.

• Any disputes shall be resolved exclusively by the courts of Alberta.

 

12. Modifications

• Brothers Industrial Services may update these Terms at any time by posting them on the website. The Terms in effect at the time of order will apply to that purchase.
